Access to recordings on the Hawaiʻi Digital Archives adhere to the copyright and public domain standards established in the Music Modernization Act. Recordings published in 1923 and earlier are in the public domain and can be freely accessed and used. Recordings published between 1923-1946 are protected for 100 years and will be made available upon lapse of terms. Recordings published between 1947-1956 are protected for 110 years and will be made available upon lapse of terms. Labels of all records are presented under fair use.
Whenever possible, the Hawaiʻi State Archives provides information about copyright owners and other restrictions in the catalog records or other texts that accompany collections. The Hawaiʻi State Archives provides such information as a service to aid users in determining the appropriate use of an item, but that determination ultimately rests with the user.
