History

The duties and functions of the Fire Marshal were established by Act 115, SLH 1917. The ex officio Fire Marshal was the Insurance Commissioner. In 1959, the Treasurer, head of the Department of Treasury and Regulation, was assigned the functions of the Insurance Commissioner including the duties of the Fire Marshal (Act 1, 2nd Special SLH). In 1963, the Department of Treasury and Regulation was renamed the Department of Regulatory Agencies (Act 114, SLH), and renamed again the Department of Commerce and Consumer Affairs in 1982 (Act 20, SLH).

Act 241, SLH 1978 abolished the Office of the State Fire Marshal and placed all responsibility for the protection of persons and property against fire loss with the county governments.

Functions, occupations and activities

The Fire Marshal, in conjunction with or through other public officers enforced all laws and ordinances of Hawaii relating to:

  1. The prevention of fires and the inspection of properties for the prevention or reduction of loss by fire, or to promote the safety of persons in case of fire;
  2. The manufacture, storage, and sale of combustibles and explosives;
  3. The installation and maintenance of automatic or other fire alarm systems and fire extinguishing equipment;
  4. Fire escapes and other means of exit from or access to building or parts of building or to property, in case of fire; and
  5. The investigation of cause, origin, or circumstances of fire and the detection and suppression of arson.
